By booking with HRT Studios, you agree to the following terms and conditions:

The services provided by HRT Studios are offered "as is" without any warranty or guarantee of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. HRT Studios makes no representations or warranties regarding the accuracy, reliability, completeness, or timeliness of the content, services, or deliverables provided. HRT Studios will not be held liable for any damages, including but not limited to, direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our services or deliverables, even if we have been advised of the possibility of such damages. Clients acknowledge that they are solely responsible for any actions taken using the deliverables or services provided by HRT Studios, and that they shall indemnify and hold HRT Studios harmless from any claims, losses, or damages arising from their use of the services or materials provided. HRT Studios is not responsible for any errors, omissions, or delays in the services or deliverables provided, or for any issues that arise from external factors beyond our control.

By using our services, clients agree to these terms and acknowledge that they understand the scope and limitations of the services provided.

SERVICES OVERVIEW

At HRT Studios, we offer a wide range of services designed to capture your vision and bring it to life with professionalism, creativity, and precision. Below is a detailed description of our services, including Video Editing, Filming, and Photo Editing.

Filming Services. Our filming services are designed to deliver high-quality, cinematic visuals that elevate your project. We offer both single-day and multi-day filming packages, providing flexibility based on your needs.

Single-Day Coverage: Our single-day filming services are perfect for smaller, focused projects. We dedicate up to 8 hours of filming on-site, capturing high-quality footage based on your shot list and project requirements. This service is ideal for events, brand shoots, and simple productions.

Multi-Day Coverage: For more complex shoots, we offer multi-day filming packages. These services are ideal for larger productions or events that require more time to capture multiple angles, scenes, or locations. We provide up to 8 hours of filming per day on both two-day and signature custom packages.

Filming Equipment & Setup: Our team uses high-quality cameras to ensure that every shot meets professional standards. We carefully plan the shot list and filming locations to achieve the desired look and feel of the project. We also offer the flexibility to accommodate any special equipment needs, such as drones, action cameras, or specialized lenses, upon request and subject to permits and approval.

Video Editing Services. Our video editing services are designed to transform raw footage into polished, cinematic pieces that tell your story with clarity and impact. Whether you need a short, dynamic video or a longer, more complex edit, we offer a variety of editing styles tailored to your needs.

Basic Video Editing: For simpler projects, we offer basic editing services, including cutting and arranging footage, basic color correction, and sound adjustment. This service is perfect for motocross riders who want clean, impactful edits of their race footage—ideal for sharing on social media, building a highlight reel, or sending to sponsors.

Premium Video Editing: For projects that require more intricate editing, we offer advanced video editing services, including immersive sound design, custom transitions, and advanced color correction. This service is perfect for motocross riders, race organizers, and action sports brands looking for cinematic visuals that capture the intensity, speed, and adrenaline of the track.

Video Length: The final video length varies depending on the scope of the project, but typical edits range from 30 seconds to 2 minutes for shorter content, with longer videos available as needed. We focus on delivering a product that matches the project’s needs while maintaining a cohesive narrative.

Sound & Music: Music is a crucial element of video production. We make every attempt to use the client’s music in the project (subject to copyright restrictions). In the event that the requested music can’t be used, HRT Studios will select music that best represents the general sound and/or theme of the requested music. If you wish to use a specific song, you understand that the music owner can grant or deny this request at its sole discretion. If music licensing is approved by the music owner and HRT Studios, you understand that such licensing may incur additional costs, and that those costs are what the music owner and HRT Studios agree upon.

Revisions: All services provided by HRT Studios are considered final upon delivery. Revisions are not included in the base package. If you would like changes made after delivery, revision requests may be accepted at the discretion of HRT Studios and will incur an additional fee.

To maintain the artistic quality and integrity of our work, we encourage clear communication and reference material before production begins.

Photo Editing Services. Our photo editing services are designed to enhance and perfect your images to suit your vision, whether for personal, commercial, or promotional use. We approach every project with the goal of making the images visually striking while maintaining their natural beauty.

Basic Photo Editing: Basic editing includes color correction, cropping, exposure adjustments, and minor touch-ups to enhance the overall look of the images. This service is perfect for riders who want clean, high-quality motocross photos with natural color correction and cropping—ideal for personal use or quick social media posts.

Advanced Photo Retouching: For more detailed work, we offer advanced retouching, including skin smoothing, background alterations, removal of distractions, and the enhancement of specific details. This service is perfect for riders and brands who want fully retouched motocross images with enhanced colors, dramatic tones, and a cinematic finish—ideal for prints, sponsorship decks, and standout social media content.

Photo Sets & Deliverables: Depending on the package selected, clients will receive a set number of edited photos. We ensure that each image is carefully selected and edited to reflect the overall aesthetic of the project. Final photos are delivered in high-resolution digital format, suitable for print or web use.

BOOKING AND PAYMENT

Booking Requirements. To secure a date with HRT Studios, all clients must confirm their booking via direct communication (in person, email, or social media message). Bookings are not final until confirmed by HRT Studios. Availability is limited and scheduled on a first-come, first-served basis.

Payment Terms. Full payment is required at the time of booking to confirm your reservation with HRT Studios. This ensures your spot is secured for the scheduled shoot/event. Payments can be made securely through our online booking system or via other approved methods. Please note: A processing fee may apply to online payments, depending on the payment method used. Clients will receive an itemized invoice or confirmation upon payment.

Sales Tax. As a Tennessee-based business, we are required by law to collect Tennessee sales tax on all applicable goods and services, regardless of the customer’s location. Sales tax will be added to your total at checkout (online or in-person).

Race/Event Attendance. If you are booking for a race or event, please note that payment does not guarantee coverage unless you confirm your attendance in advance. Riders must notify HRT Studios of their race number, class, and heat/time slot. If attendance is not confirmed and you are not located at the event, we reserve the right to release your booking spot to another client.

Late Payments. Failure to pay by the agreed-upon date may result in delays in content delivery or cancellation of the project. For clients requesting payment extensions, arrangements must be made in advance and are subject to approval.

CANCELLATIONS AND REFUNDS

HRT Studios understands that plans can change, and we strive to be as flexible as possible. However, due to the time and preparation required for each shoot, the following cancellation and refund policy applies:

Standard Cancellation Policy. Cancellations made 15 or more days before the scheduled shoot date are eligible for a full refund of the total amount paid. Cancellations made between 14 and 8 days prior to the scheduled shoot will receive a 50% refund of the total amount paid. Cancellations made within 7 days of the scheduled shoot are non-refundable.

Short-Notice Cancellations (Less Than 48 Hours). If cancellation occurs within 48 hours of the scheduled shoot, the entire payment will be forfeited, and no refund will be issued, regardless of attendance. This policy is in place to compensate for lost time and opportunities to book other clients.

No-Shows. If a client fails to show up on the day of the scheduled shoot or does not confirm attendance (for event coverage), the session will be considered a no-show. No refunds will be issued, and the full balance will be due.

Event Cancellations (Organizer-Initiated). If a booked event is officially canceled by the event organizer or venue, clients will be eligible for a full refund of all payments made or may choose to apply the payment to a future booking, subject to availability. Proof of event cancellation may be required.

Studio Cancellations. In the rare case that HRT Studios must cancel a scheduled session due to emergency, illness, or other unforeseen circumstances, clients will receive a full refund or may reschedule at no additional cost.

Refund Processing. Eligible refunds will be processed within 5–7 business days and issued via the original payment method unless otherwise agreed upon.

RIGHT TO REFUSE SERVICE

HRT Studios reserves the right to refuse service to any client for any reason at our sole discretion. This includes, but is not limited to, the following circumstances:

Non-Compliance with Terms of Service
If a client fails to comply with the terms and conditions outlined in this agreement, including but not limited to late payments, failure to provide required information or materials, or repeated changes to the agreed-upon schedule or scope of work, HRT Studios reserves the right to cancel or refuse service without refund.

Disrespectful or Inappropriate Behavior
HRT Studios maintains a professional environment and expects the same from all clients. Service may be refused if the client or any individuals associated with the client engage in any behavior that is disruptive, disrespectful, abusive, or harmful to the work environment, including but not limited to:

Verbal or physical abuse
Threats of harm or violence
Harassment of any kind (sexual, racial, or otherwise)
Substance abuse (e.g., alcohol or drugs) on the premises or during the session

Safety Concerns
If, during a shoot or event, HRT Studios determines that the environment or activities pose a risk to the safety and well-being of the crew, client, or others present, we reserve the right to immediately halt the session and refuse further service. This includes unsafe working conditions or failure to adhere to safety guidelines.

Failure to Provide Necessary Information or Cooperation
If a client fails to provide key information (e.g., event details, specific shot lists, race schedules, or other critical logistics) or does not cooperate with the studio’s direction, service may be refused. This also includes failure to communicate attendance or failure to meet agreed-upon deadlines.

Unlawful Activities
HRT Studios reserves the right to refuse service to any client engaged in illegal activities or activities that may compromise the integrity of the studio's work, reputation, or compliance with local laws.

Unpaid Balances
If a client has an outstanding balance from previous services, HRT Studios reserves the right to refuse additional services until the balance is paid in full.

Refunds and Cancellations in Case of Refusal
If service is refused under any of the circumstances outlined above, no refund will be issued. The client is still responsible for any outstanding fees or balances due up to the point of service refusal.

DELIVERY TIMELINE

At HRT Studios, we are committed to delivering high-quality content within a timely manner. The following outlines our standard delivery timeline for both photography and video services:

Photography & Video Deliverables

For all packages, final edited photos and videos will be delivered together within 5–10 business days from the date of the shoot.

Rush Editing: If you require a quicker turnaround, rush editing services can be requested for an additional fee, subject to availability. Rush delivery will be within 3–5 business days.

Delivery Method
Final deliverables will be provided through a secure online file transfer service, such as Google Drive. The client will receive a download link via email to access the files.

Delays and Communication
While HRT Studios strives to meet the stated delivery timelines, unforeseen circumstances (e.g., technical issues, excessive editing requests, or personal emergencies) may cause delays. In such cases, clients will be notified promptly, and a new delivery date will be established. We recommend clients communicate any urgent requests or deadlines upfront to ensure we can accommodate them within the expected timeline.

CLIENT RESPONSIBILITIES

To ensure a smooth and successful shoot, it is essential that clients fulfill certain responsibilities. These responsibilities help HRT Studios prepare for your session, ensure we meet your vision, and provide the highest quality of service. The following outlines the client responsibilities:

Submission of Music Requests and Notes
Clients are required to submit any music requests and specific notes at least 3 days prior to the scheduled filming. This allows HRT Studios to adequately prepare for the shoot, plan the necessary equipment, and ensure that the creative direction is aligned with your expectations.

Music Requests: If you have specific music preferences for the video, please provide the track(s) or genre ideas at least 3 days before the shoot. I will secure the necessary music rights on your behalf; however, please note that the pricing for the project may change to include the cost of licensing. Licensing will be granted to HRT Studios and is subject to approval from the music owner or copyright holder. Licensing cannot be guaranteed and is subject to approval.

Additional Notes: If there are any special requests or notes, such as specific edits, stylistic choices, or other preferences, these should also be communicated prior to filming. The more detail you provide, the better we can tailor the project to meet your expectations.

Cooperation and Communication During Filming
During the shoot, the client is responsible for providing clear communication regarding their preferences and any necessary adjustments. While HRT Studios will direct the session, your input is important for the final product.

If there are any specific moments or angles you want captured, please communicate them during the shoot.

Clients should ensure that all participants (e.g., models, crew, or any third parties) are available and prepared for the scheduled shoot time.

Punctuality and Attendance
Clients are expected to arrive on time for all scheduled shoots. Delays or changes to the schedule may affect the shooting time or availability of equipment. In the case of a late arrival, HRT Studios will still proceed with the scheduled shoot, but the session may be shortened, and the client will still be charged for the full session.

Venue and Location Preparation
If the shoot is held at a location other than the studio (e.g., a motocross track, outdoor venue, or event), the client is responsible for ensuring that the location is accessible and prepared for the shoot. This includes obtaining any necessary permits and making sure the location is safe for all involved.

Note: HRT Studios is responsible for obtaining the necessary permits and licenses for packages related to riders in general cases.

Props, Wardrobe, and Equipment
The client is responsible for providing any props, wardrobe, or special equipment needed for the shoot, unless otherwise agreed upon. Please confirm all props and wardrobe items in advance. If you require specific items to be provided by HRT Studios, please notify us before the shoot so we can make arrangements.

Payment and Scheduling

Clients are responsible for adhering to the payment schedule and settling the full balance at the time of booking. HRT Studios requires full payment to secure the booking, and the payment must be received according to the terms stated in the agreement.

Feedback and Revisions
Following the delivery of your edited photos and/or videos, clients are responsible for providing feedback in a timely manner. If revisions are requested, they should be specific and clear to ensure accurate changes. Keep in mind that revisions are not included in the basic package, and any additional edits will incur extra fees.

Client-Provided Content
If the client provides any content (such as logos, branding, or other media), it is the client’s responsibility to ensure that they have the rights to use and distribute the content. HRT Studios is not liable for any infringement issues regarding client-provided media.

Compliance with Studio Policies
Clients must adhere to the studio's policies and guidelines during the session. Any actions or behaviors that disrupt the session, violate safety protocols, or cause damage to studio property may result in immediate termination of the session and forfeiture of any payments made.

USAGE AND RIGHTS

The following section outlines the usage rights and ownership terms for all photos and videos created by HRT Studios. By engaging in our services, the client agrees to the following terms regarding the usage and distribution of the final products:

Ownership and Copyright

All photos and videos taken and produced by HRT Studios remain the property of HRT Studios and are protected by copyright law.

The client is granted a license to use the final deliverables for personal, commercial, or promotional purposes as agreed upon at the time of booking.

The client does not have ownership of the raw footage or unedited photos and videos unless otherwise specified in the agreement. The client’s usage rights are limited to the final edited deliverables.

License Grant

Personal Use: The client is granted a non-exclusive, non-transferable license to use the final edited media (photos and/or video) for personal use only, including but not limited to sharing on personal social media accounts, personal websites, and non-commercial purposes. The client may not sell, alter, redistribute, or use the content for commercial purposes (e.g., advertising, product promotion, or resale) without prior written consent and a separate commercial licensing agreement with HRT Studios. All rights not expressly granted remain the sole property of HRT Studios.
Commercial Use: If the client intends to use the deliverables for commercial purposes (e.g., marketing campaigns, advertisements, or branded content), a separate commercial license may be required. Additional fees may apply based on the intended scope and duration of use.

The client is prohibited from reselling, sublicensing, or distributing the final deliverables without prior written consent from HRT Studios.

Usage Restrictions

The following restrictions apply to the use of photos and videos created by HRT Studios:

No Unauthorized Modifications: The client is not authorized to alter, edit, or modify the final deliverables beyond basic cropping or resizing unless agreed upon in writing.

No Misrepresentation: The client shall not use the final deliverables in any manner that could mislead or misrepresent the intent or context of the work, including but not limited to using the images or video in a defamatory, illegal, or controversial context.

No Distribution Without Credit: For editorial or commercial uses, the client must provide proper attribution to HRT Studios when appropriate. This includes crediting HRT Studios as the creator of the photos or video when used on social media, in print, or in other public forums.

Client's Rights to Use

The client retains the right to use the photos and videos for the following purposes:

Displaying the images and videos on personal or business websites, social media platforms, or digital platforms (subject to the terms and restrictions above).

Printing photos for personal use or display, and creating promotional or marketing materials, such as flyers, brochures, or advertisements, as long as these materials do not exceed the agreed-upon scope of use.
Using the footage in promotional videos or online content, provided that such usage aligns with the agreed-upon terms.

HRT Studios’ Right to Use

HRT Studios reserves the right to use photos and videos created for marketing and promotional purposes. This includes but is not limited to:

Displaying the work in HRT Studios' portfolio, website, social media accounts, and promotional materials.

Using behind-the-scenes or edited images/videos for case studies or industry-related content.

Sharing the work with potential clients for demonstration purposes or in any other manner that promotes HRT Studios' services.
The client agrees to allow HRT Studios to use their images or video for these purposes, unless explicitly stated otherwise in the agreement.

Model Releases and Property Releases

Clients may be asked to sign a model release or appearance release prior to or on the day of the shoot. This release is required for HRT Studios to use any footage or photos in portfolios, social media posts, promotional materials, advertisements, or other marketing content.
If third parties are involved in the shoot, the client agrees to assist in ensuring that all participants sign the appropriate releases provided by HRT Studios.

Music Licensing

If the final video includes music, HRT Studios is responsible for selecting and sourcing music for the project when applicable. Music used is typically selected based on the intended feel and purpose of the edit.

When HRT Studios provides the music, the license granted to the client applies only to the final edited video and only for the specific usage agreed upon (e.g., personal use, social media, non-commercial promotion, etc.).

The client is responsible for understanding and adhering to the limitations of the music usage, which may restrict redistribution, commercial use, monetization, or posting on certain platforms.

Unless specifically requested by the client and agreed upon in writing prior to the start of the project, music will not be licensed. Clients should understand that the music used in their video may be copyrighted by its original owner. As a result, videos may be muted, flagged, or removed on platforms such as Instagram, YouTube, TikTok, or Facebook depending on their copyright enforcement policies. HRT Studios is not responsible for ensuring the music in your video is free from potential copyright claims unless licensing is explicitly included in the agreement.

HRT Studios is not liable for any copyright claims, takedowns, muting, or legal disputes resulting from the use of unlicensed music. If guaranteed clearance or platform-safe music is required, the client must request licensing in advance and additional fees may apply.

Termination of Rights

HRT Studios reserves the right to revoke or terminate any usage rights granted to the client if the client fails to comply with these terms. In such cases, the client must cease all use of the deliverables immediately.

LATE PAYMENT AND NON-PAYMENT

In the event that full payment is not made at the time of booking or within 2 days of the filming session, HRT Studios reserves the right to suspend all work until payment is received. If payment is not made within 7 days, HRT Studios may cancel the contract, and the client will still be responsible for the full balance of the booking.

DISPUTE RESOLUTION

In the event of a dispute, both parties agree to first attempt to resolve the issue through mediation. If mediation fails, the dispute will be settled through arbitration in accordance with Tennessee state laws.

PRIVACY AND DATA PROTECTION

HRT Studios values your privacy and takes steps to protect your personal data. Any personal information provided during the booking process will be stored securely and will only be used for project-related purposes. We will not share your information with third parties without your consent unless required by law.

REVISIONS AND CHANGES TO THESE TERMS

HRT Studios reserves the right to update or revise these Terms of Service. Any changes will be communicated to the client via email or posted on our website. Clients will be subject to the terms in effect at the time of booking.

FORCE MAJEURE

HRT Studios shall not be held liable for any failure or delay in performance of its obligations under this agreement, including but not limited to, filming, editing, or delivery, caused by events beyond its reasonable control. These events include, but are not limited to, acts of God, natural disasters (e.g., floods, hurricanes, earthquakes), pandemics, government regulations, civil unrest, war, terrorism, technical failures, labor strikes, transportation delays, or any other cause beyond the control of HRT Studios. In the event of a Force Majeure situation, HRT Studios will make reasonable efforts to reschedule the affected services. If a rescheduling is not possible or practical, the client will be informed as soon as possible. Both parties will work together in good faith to find a mutually acceptable solution.
